SCOPE Europe and the EU Cloud CoC sharing joint comments on public consultation

The European Data Protection Board (EDPB) adopted their “Guidelines 04/2021 on codes of conduct as tools of transfers” as of July 7th, 2021. One week later, the EDPB launcheda public consultation to welcome feedbacks on the Guidelines. Given the relevance of this topic, SCOPE Europe and the EU Cloud CoC General Assembly are thrilled to share their joint comments on the Guidelines.

The aim of these Guidelines is “to specify the application of Article 40-3 of the GDPR relating to codes of conduct as appropriate safeguards for transfers of personal data to third countries in accordance with Article 46-2-e) of the GDPR” (Guidelines 04/2021, p.3).

SCOPE Europe and the EU Cloud CoC consider such Guidelines to be an essential piece of guidance for the development of  robust privacy standards in the context of international data transfers. This platform to exchange with European supervisory authorities is crucial for the continuous development of efficient co-regulatory solutions and, in particular, for the design of our EU Cloud CoC’s Third Country Initiative.

We greatly appreciate the opportunity to share our perspectives in the context of this consultation and hope our feedback will meaningfully contribute to the update of the Guidelines. In this context, we look forward to continuing our engagement with the EDPB as well as other key stakeholders for the upholding of high data protection standards in Europe and beyond.
