New Casebook European Data Law Features Chapter on GDPR Codes of Conduct

European Data Law: Ten Years of the GDPR has recently been published, marking a decade since the adoption of this pioneering regulatory framework and reflecting on the evolution of European data protection law over the past decade.

Edited by Rolf Schwartmann, Marek Steffen Jansen, and Moritz Köhler, the publication brings together contributions from leading experts in the field, exploring a range of practical use cases and examining how the GDPR has been interpreted and implemented in practice.

SCOPE Europe’s Managing Director, Gabriela Mercuri, features among the authors, contributing a chapter dedicated to codes of conduct under the GDPR. Drawing on her experience in the development and monitoring of codes of conduct, Gabriela examines two EDPB opinions on approved GDPR codes of conduct, dissecting how regulatory requirements have been translated into concrete legal interpretations. The contribution offers insights into the way these instruments can bridge the gap between the GDPR’s general principles, and the specific compliance needs of organisations.

The chapter highlights the underutilised potential of codes of conduct under the GDPR, particularly in light of the relatively small number of these instruments that have successfully reached the market so far. Gabriela’s analysis illustrates how these tools can contribute to a more practical, proportionate, and sector-specific implementation of the GDPR, while providing greater clarity and accountability.
